Welcome to Giftu! These Terms and Conditions govern your use of our platform and constitute a binding agreement between you (the "User") and Giftu ("we," "our," or "us"). By accessing or using Giftu, you agree to comply with these terms.
2. Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction to use Giftu. By using our platform, you confirm that you are legally capable of entering into a binding agreement.
3. Account Registration and Security
- Users must provide accurate and up-to-date information during registration.
- Users are responsible for maintaining the confidentiality of their account credentials.
- Notify us immediately of any unauthorized access to your account.
4. Use of the Platform
Giftu is intended for personal, non-commercial use. You agree not to:
- Engage in unauthorized marketing or promotional activities.
- Attempt to hack, disrupt, or misuse the platform.
5. Purchases and Payments
All purchases made on Giftu are subject to the following conditions:
- Payment Processing: Payments are processed through third-party payment gateways. We do not store your payment information.
- Service Fee: In addition to the price of the items in your order, a service fee ("Service Fee") could be applied to each transaction made through the Giftu platform. This fee helps us operate our platform, provide customer support, and continuously improve our services. The exact amount of the Service Fee will be clearly and separately displayed to you on the checkout page before you confirm your payment.
- Total Price: The total price you pay is the sum of the e-gift card value, any applicable taxes, and our Service Fee. By completing the purchase, you agree to pay the total amount displayed at checkout
6. E-Gift Card Terms
The following terms apply to e-gift cards purchased through Giftu:
- Delivery Confirmation: Digital gift cards are deemed delivered once displayed in the customer’s account after payment confirmation.
- Finality of Sale: All purchases of digital gift cards are final and non-refundable once delivered, except as required by law or in cases of technical error by Giftu.
- Customer Responsibility: Customers are solely responsible for securing their gift card codes after delivery. Giftu is not liable for lost, stolen, or misused codes.
- Restrictions may apply based on the card issuer’s own terms.
7. Fraud & Disputes
- In case of a disputed transaction, Giftu will provide all available documentation (invoices, delivery logs, verification records).
- Giftu is not responsible for fraudulent transactions that passed successful authentication.
8. Intellectual Property Rights
All content on Giftu, including trademarks, logos, and text, is owned by us or our licensors. You may not copy, modify, or distribute any content without our permission.
9. Third-Party Services and Links
Giftu may include links to third-party services or websites. We are not responsible for the content, policies, or practices of these external sites.
10. Limitation of Liability
Giftu is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform.
11. Termination
We may terminate or suspend your access to Giftu at our discretion, without prior notice, if you violate these terms.
12. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of Saudi Arabia. Any disputes shall be resolved through arbitration in accordance with local regulations.
13. Changes to the Terms
We may update these Terms and Conditions periodically. Users will be notified of significant changes through in-app notifications or banners.
